Article 1 | Definitions

The following definitions apply to these general terms and conditions:

1.1 general terms and conditions: these general terms and conditions of Lois.

1.2 Right of withdrawal: the option on the part of the client, within the statutory reflection period, to abandon the distance contract in question.

1.3 Customer: the other party, a natural person, with whom Lois enters into an agreement and who is not acting for purposes connected to a commercial, business, craft or professional activity.

1.4 Lois: the party as defined below in these general terms and conditions.

1.5 Ordering procedure: the procedure which the customer follows while ordering products from the Lois webshop.

1.6 Distance contract: agreement for the sending and supply of products in the context of an organised system for distance selling and in which the general terms and conditions of Lois are integrated.

1.7 Products: fashion products offered by Lois to the customer on its website.

1.8 Webshop: the online shop of Lois on its website.

1.9 Website: the website of Lois under the following URL: www.loisjeans.com

Article 2 | Applicability

2.1 These general terms and conditions apply to all offers of Lois and all agreements entered into with Lois.

2.2 The provisions of these general terms and conditions can solely be deviated from in the event that this is agreed to explicitly in writing, without prejudice to the remaining provisions of these general terms and conditions, which shall remained unimpaired.

2.3 Lois reserves the right, from time to time, to amend or supplement these general terms and conditions.

2.5 By using the website of Lois and/or placing an order, the customer approves these general terms and conditions as well as all other rights and obligations as stated on the site.

2.6 Lois is authorised to enlist the help of third parties in executing a distance contract.

Article 3 | Effecting of an agreement

3.1 An agreement shall be considered to have been effected at the moment that an offer of Lois has been accepted by the customer. Lois shall in turn send a relevant purchase confirmation to the customer.

3.2 Lois is unable to guarantee that offers will not contain errors or other exceptions. Lois is not liable for manifest clerical errors and shall in such cases not be obliged to comply with the distance contract in question or, as the case may be, authorised to terminate it. In the event of a manifest clerical error, Lois shall call it to the attention of the customer as soon as possible.

3.3 Offers shall be valid for so long as the relevant supply lasts and limited in duration. In the event that it is no longer possible to order a given product, this shall be communicated to the customer at the latest during the purchase process.

Article 4 | Prices and payment

4.1 Prices as mentioned on the website are inclusive of VAT and exclusive of any shipping costs. Any additional obligatory costs, e.g., shipping costs, are separately indicated in the purchase process.

4.2 The amount as yet to be paid can be paid by the customer:

a. by means of electronic payment (iDeal);

b. by means of payment with a credit card (Mastercard/Visa).

c.  by means of payment with Bancontact / Mr Cash.

d. by means of payment with Giropay.

e. by means of payment with Maestro.

f.  by means of payment with Paypal.

4.3 Lois is entitled, in the future, to expand the list of payment methods. Other payment methods shall be indicated via the website.

4.4 In the event that payment with a credit card is opted for, the terms and conditions of the issuer of the card in question shall apply to the payment. Lois shall not be a party in the relationship between the customer and the issuer of the card.

4.5 In the event of non-payment or late payment by the customer, until the date of payment in full, statutory rent shall be payable on the amount outstanding from the date on which payment should have taken place at the latest and following notice of default.

4.7 Also chargeable to a customer in default with regard to his/her payment obligation shall be all (extra-)judicial costs regardless of type, incurred by Lois as a result of the customer’s non-compliance  of his/her (payment-)obligations.

4.8 In the event of late payment, Lois shall be authorised to terminate the distance contract with immediate effect or cancel (further) delivery until such time as the customer fully has complied with his/her payment obligation, including the payment of all interest and costs owed.

Article 5 | Delivery

5.1 Ordered items shall be delivered as soon as possible. Lois aims to send the products ordered within the delivery periods stated on the website. The delivery periods stated are however not final deadlines.

5.2 If Lois is not able to deliver the product in question within a period of thirty days, the customer shall have the right to terminate the distance contract and shall be entitled to a refund.

5.3 At the moment that the products to be delivered have been delivered to the delivery address supplied, all risks in respect of these products shall pass to the customer.

Article 6 | Right of withdrawal

6.1 The customer is obliged thoroughly to inspect the products immediately following receipt.

Following their receipt, the customer shall be entitled to return the products to Lois within a period of fourteen days, without giving reasons, while employing the standard withdrawal form provided by Lois. Withdrawal within the period provided for it can take place on condition that:

a. the customer has handled the product with care, the product is in good condition and it has not been worn, and all price tags and/or labels are included.

b. the customer him/herself bears the costs of return shipping.

c. the customer him/herself takes responsibility for the manner in which the product is shipped back and bears all appurtenant risks until the moment of receipt by Lois.

6.2 In connection with the return of the product as set out above, the customer shall be entitled to a refund for a period of thirty days following the invoking of the right of withdrawal and receipt of the product by Lois. The risk and burden of proof of correct and timely exercise of the right of withdrawal shall rest with the customer.

Article 7 | Complaints

7.1 Lois guarantees that its products and/or services are compliant with the agreement, the specifications stated in the relevant offer, the reasonable requirements of soundness and/or utility and the provisions in effect as at the date of the effecting of the agreement.

7.2 In the event that the product fails to correspond to the expectations of the customer, he/she can contact Lois by means of the complaint form or via the customer service department.

7.3 The customer must fill in the complaint form completely and send it to the email address stated below in these general terms and conditions.

7.4 In such a case, the customer him/herself shall be responsible for the manner in which the product is shipped back. The risk and burden of proof of shipping shall rest with the customer up to the moment of receipt by Lois.

7.5 In the event that, following inspection by Lois, the product appears to exhibit defects, the customer shall be entitled to a replacement. Lois shall refund to the customer the value of the product increased by any shipping costs as may apply. The refund shall, in principle, take place via the same method of payment as that employed by the customer in ordering the product. The customer shall then be given the opportunity, with the refunded sum, to order and purchase the same product or – in the event that the product is no longer in stock – an alternative product from the webshop of Lois.

Article 8 | Processing of personal details

8.1 The customer’s personal details shall be processed solely in the context of executing the distance contract.

8.2 The consent of the customer shall be requested prior to the sending of any promotional emails or the like.

8.3 The customer shall at all times be entitled to check and/or emend his/her personal details.

Article 9 | Intellectual property

9.1 The customer explicitly acknowledges that all intellectual property rights attaching to the products and/or the relevant information displayed, as well as all notices or other communications concerning the products and/or website, rest with Lois or other rights holders.

9.2 Intellectual property rights are here defined as patent rights, copyright, trademark rights, design and model rights and/or other (intellectual property) rights, also including rights pertaining to data bases or other products of commercial knowhow.

9.3 Without consent from Lois, the customer is prohibited from using the intellectual property rights as described in this article, e.g., by means of reproduction and/or publication, except where non-commercial use in the private sphere in respect of the product itself is involved, which prohibition extends to the introduction of modifications.

Article 10 | Applicable law; disputes

10.1 To all offers and agreements, solely Netherlands law shall apply. Applicability of the Vienna Sales Conventions is explicitly excluded.

10.2. Any disputes connected to or issuing from offers of Lois or agreements concluded with Lois shall be submitted to the competent court of jurisdiction for adjudication.
